Educational purpose only

Praxana provides general educational content, analysis and training tools relating to anti-money laundering, financial crime and compliance topics. Nothing on this site constitutes legal, financial, regulatory or professional advice, and it should not be relied upon as a substitute for advice from a qualified professional or your own organisation's compliance function. See the Disclaimer page for further detail.

Membership and plans

Some content and features are available only to registered members, and some require a paid plan. We may change what is included in each plan from time to time; where reasonably possible we will give notice of material changes affecting paid members.

Accuracy of Account Information

You must provide accurate and current information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Cancellation and Refunds

Paid plans renew automatically at the end of each billing period unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period, and you'll retain access until then. Except where required by law (including the Australian Consumer Law) or expressly stated otherwise, fees already paid are non-refundable, whether you cancel or we terminate your account for breach of these terms.

Acceptable use

You agree to use this site lawfully and for its intended purpose. In addition to the general obligation not to disrupt the platform or gain unauthorised access to other accounts or systems, you must not: — share your login credentials with, or allow access to your account by, any other person; — use any automated means (including bots, scrapers or data-mining tools) to access, copy or extract content from this site; — upload or transmit any virus, malware or other harmful code; — harass, threaten, impersonate or abuse another member or a member of the Praxana team; or — reproduce, resell, republish or redistribute paid content without our prior written permission. Accounts found to be in breach of this section may be suspended or terminated without refund

Intellectual property

All articles, training materials, the simulator and other content on this site remain the property of Praxana (or its licensors) and are provided for your personal use as a member. You may not copy, resell or publish this content elsewhere without prior written permission.

Insights articles and other content on this site may link to third-party websites, including regulators and news sources, for reference. We do not endorse and are not responsible for the content, accuracy or availability of any third-party site.

Trademarks and Branding

'Praxana' and associated logos are trademarks or branding of Praxana. You may not use our name, logo or branding without our prior written permission, except as reasonably necessary to refer to us factually (for example, in a hyperlink).

Changes to the Platform

We may add, remove or change features, content, pricing structures or the way the simulator operates from time to time. We will act reasonably and, where a change is likely to materially reduce what's available to existing paid members, we will give reasonable notice.

Limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the maximum extent otherwise permitted by law: (a) Praxana excludes all liability for indirect, special or consequential loss, loss of profits, loss of business, loss of goodwill or loss of data, however arising; and (b) Praxana's total aggregate liability to you for any claim arising out of or in connection with these terms or your use of the site, whether in contract, tort (including negligence) or otherwise, is limited to the total fees you paid to Praxana in the 12 months before the event giving rise to the claim. This limitation applies to the training simulator, which is a fictional educational tool and is not connected to any real customer, transaction or regulatory system.

No Warranty

This website, the simulator and all content are provided on an 'as is' and 'as available' basis. To the extent permitted by law, we make no warranty that the site will be uninterrupted, error-free or secure, and we exclude all implied warranties and conditions except those that cannot be excluded under the Australian Consumer Law.

Service Availability

We aim to keep the site and simulator available at all times but do not guarantee uninterrupted access. We may suspend access for maintenance, updates or reasons outside our reasonable control, and will restore access as soon as reasonably practicable. To the extent permitted by law, we are not liable for any loss arising from planned or unplanned downtime.

Indemnity

You indemnify Praxana against any loss, damage, cost or liability (including reasonable legal costs) that Praxana incurs as a result of your breach of these terms, your misuse of the site, or your violation of any law or third-party right, except to the extent caused by Praxana's own negligence or breach of these terms.

Termination

You may close your account at any time from your account settings. We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these terms, misused the platform, or engaged in unlawful conduct. On termination, your right to access paid content and the simulator ends immediately. Clauses which by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnity and Governing Law — continue to apply

Changes to these terms

We may update these terms from time to time; continued use of the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Australia, unless local law requires otherwise.

No Waiver

A failure or delay by Praxana in exercising any right under these terms does not operate as a waiver of that right. Any waiver must be in writing to be effective.

Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be read down to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Dispute Resolution

If a dispute arises out of these terms, the parties will first attempt to resolve it in good faith through direct negotiation. If it is not resolved within 30 days, either party may refer it to mediation administered by a recognised Australian mediation body before commencing court proceedings, except where a party seeks urgent interlocutory relief or is recovering a debt.

Assignment

You may not transfer or assign your account or any rights under these terms without our prior written consent. We may assign or transfer our rights and obligations under these terms, including in connection with a sale, merger or restructure of our business, and will take reasonable steps to notify members of any such change that affects their membership.
